Don't Attempt to Handle Your Case Alone

You may not know where to turn after an accident at work. Don't blindly trust that you're getting the compensation you are entitled to.

A workers’ compensation case starts immediately when the injury on the job occurs. Notice is an important element to a workers’ compensation claim. An employee must notify their employer of the injury in a timely fashion, meaning as soon as possible. After being notified that an injury has occurred, the employer is required to file a “first report of injury."

An employee also needs to be aware that they may or may not be able to choose the doctor that they want to treat their injury. If it is not possible to settle the claim, a Petition is filed with the Nebraska Workers’ Compensation Court and Discovery begins.

Discovery is used by both the Plaintiff and the Defendant to evaluate the strengths and weaknesses of a case and often includes interrogatories, requests for production, and depositions.

The case will eventually be scheduled for trial and the outcome of that trial will depend in large part upon how well the case was developed from start to finish. This is why it is so important to retain an experienced workers’ compensation attorney as soon after the injury has occurred as possible.
